Obtained Video Clearly Shows Mayor Nelson Weaponized Police Against Resident




On February 22, 2024, Franklin Community News (FCN) published an article 
entitled "Franklin Resident Alleges Mayor Nelson "Weaponized" Police Department as Political Payback"

FCN has obtained video footage via an open records request from the February 22, 2024, Franklin Common Council Meeting that Mayor Nelson did indeed Weaponize the Franklin Police Department against Dr. Richard Busalacchi as Busalacchi had alleged.  The video received was before the 6:30pm start time of the meeting from three different camera angles. 

Video 1 shows Nelson approaching Officer Thompson at about 6:20pm before the Common Council meeting at 6:30pm.  Busalacchi walked in, the Mayor said Hi Mr. Busalacchi, shook his hand, and made a comment similar to “I hope you are going to behave tonight”.  Busalacchi responded thinking the comments were intended to be funny “Maybe”.  Busalacch then went and took a seat in the audience as Busalacchi intended to make public comments pertaining to the outstanding taxes owed by ROC Ventures and the agenda item on TID#5.

The video clearly shows as Busalacchi walks in, Nelson points out Busalacchi to Officer Thompson as to indicate "That's him".

Video 2 shows Officer Thompson at about 6:23pm, 3 minutes later after Nelson pointed Busalacchi out, Officer Thompson approached him, tapped him on the shoulder, and asked him to step into the hall with the officer.  In the hallway Officer Thompson cautioned Busalacchi to be careful about his remarks so as not to cause a disruption.  He also indicated that it has been reported that Busalacchi has caused disruptions and disturbances at past common council meetings.


Busalacchi then went back to his seat.  Busalacchi was the second citizen to make a public comment.  You can see his comments on the video of the meeting at the 4:35 mark.

Busalacchi went the same evening to the Franklin Police Department to file a complaint of harassment against the Mayor and the Police Department would not take a formal complaint against the Mayor.  Busalacchi has been to the Police Department at least three times to file complaints and was told that the department has been directed by the Chief to not accept any complaints from Busalacchi.

Previous Common Council Videos of Busalacchi making public comments will not show Busalacchi in any way being disrespectful or causing interruption at any Franklin Common Council Meetings.  What the videos will clearly show on multiple occasions is the Mayor interrupting Busalacchis public comments and on multiple occasions calling Busalacchi a liar.  Meeting videos do not show the mayor doing the same for other speakers during public comment.

As Franklin Community News reported on March 27, 2024, formal allegations have been made against Franklin Mayor John Nelson that he worked in a conspiracy with Steve Taylor, County Supervisor/ROC Foundation Executive Director, and Mike Zimmerman, CEO of ROC Ventures to silence the 1st Amendment Rights along with conspiracy to interfere with the employment of a Franklin Resident and Publisher of FCN News, Dr. Richard Busalacchi.

Busalacchi filed a formal complaint with the City of Franklin on April 4, 2024, and asked for a formal investigation into his allegations.  At the April 16, 2024 Common Council meeting the item was on the agenda in closed session.  After about one hour the council came out of closed session and took no action.  It is also important to note that one of the first actions the Mayor and the Council took after the Mayor was elected was to not accept any ethics complaints.

Busalacchi claims, with documented proof of each, that the City of Franklin Mayor John Nelson committed the following since April 4, 2023:

  • ●  Participated in a conspiracy with County Supervisor Steve Taylor and ROC Owner/Operator Mike Zimmerman to silence his 1st Amendment Rights.

  • ●  Participated in a conspiracy with Steve Taylor and Mike Zimmerman to interfere with his employment.

  • ●  Provided false information to a Franklin Police Officer to weaponize the police department against him.

  • ●  Participated in a conspiracy with Taylor, Zimmerman, Supervisor Kathleen Vincent/School Board member for the Village of Greendale, and a local employee to harass him under the WI Statute 947.013

  • ●  Worked in a conspiracy to stalk Busalacchi with Taylor, Zimerman, Vincent,  under the WI Statute 940.32

  • ●  Purposefuly withheld responsive open records to (John.1968Nelson@gmail.com) email account and the (jnelson@waterfordpd.com) email account. A violation of state Statues 19.37(3)(4)

  • ●  The City of Franklin Police Department has refused to accept these and other related complaints to be investigated. The City of Franklin Police Department has not provided him equal protection of the laws under the 14th Amendment.

Busalacchi is deeply troubled and concerned that the actions taken by the Franklin Police Department were politically motivated by Mayor Nelson and/or a member of his Administration.  It was very apparent and clear from the video that Busalacchi was the target of this ”operation” and it was intended to intimidate and harass him in an attempt to suppress his public comments.  It is also apparent that the Mayor and/or someone from his administration lied to the Franklin Police Department with knowingly false information about him.


It is Busalacchi's contention that actions by the Franklin Police Department are political payback.  Political payback on behalf of Mayor Nelson and/or his staff and/or other politicians and/or business associates.  It was direct retaliation, intimidation, suppression of speech (during public comment), and infringement of his 1st amendment rights.  This political payback was intended because of filing open records requests, conducting meticulous research, and writing and posting articles that do not portray Franklin's current city leadership and certain local businesses in the best light. 


John Nelson is not just the Mayor, he is also a full-time Police Lieutenant in Waterford and should have known better. The Mayor continues a trend of not being truthful.

The Tuesday, April 4th hotly contested mayoral election came to an end with absentee ballots 4500, still being counted at 10:30pm and the challenger John Nelson ahead of incumbent Steve Olson by 1000 votes.  Late in the evening when all the ballots were reported according to the Milwaukee Journal Sentinel "Nelson received 6,703 votes (56.59%) while Olson received 5,099 votes (43.05%). There were 43 write-in votes accounting for the remaining 0.36% of votes cast. Franklin had a 55.37% voter turnout."

Franklin voters have cause to be worried and concerned.  Sometimes change is good and warranted for the right reasons.  However, in this particular instance, we are not sure the majority of voters knew exactly what they were getting.   Most voters were not aware that by electing Nelson they were getting a three-for-one package of government moving forward for the next three years.

Yes, Franklin voters welcome to your new Mayoral triumvirate. Moving forward to be known as the "Rat Pack".  We thought about the "Three Stooges". but had a hard time identifying who would be Curley or Shemp.  The next best was the "Rat Pack". Please know all respect and homage is given to Frank, Sammy, and Dean.  However, this better describes our new leadership.

We do know that Mr. Nelson was duly elected as Mayor of Franklin. What we are not sure of is who really is the brains of the operation and who is pulling who's string and for what purpose and gain.  Like Roz said in the great movie Monsters Inc.  "We'll Be Watching You.

Some comments have been made toward Mayor Olson that the Mayor should feel shameful and some are disgusted that he did not offer a concession to Mr. Nelson, or is it Mr. Taylor, or is it Mr. Zimmerman?  Let us fill you in on the truth that you did not hear and what really happened.

At about 9:45pm election night, while waiting for the 4,500 absentee ballots to be reported from Franklin Central Count to the County Elections Office, Mayor Olson and some of his campaign advisors received the following text from Mr. Taylor on behalf of the “Rat Pack”.


Yes, just the picture, and nothing else.  How absolutely arrogant and smug.  This is the individual(s) the voters of Franklin elected.  Nelson's header on his campaign web page proudly lists "Time to Restore Respect. Time for Focused Leadership." and he continues with "And, perhaps most importantly, he will restore a positive structure at city hall for citizens, developers and employees alike. "   

So Mr. Nelson and the "Rat Pack", not even in the Mayor's seat yet (we heard the Common Council Room will be retrofitted with a love seat at the head of the table to accommodate the "Rat Pack") this is the first display as a leader(s) of the citizens of Franklin and this is how you "show respect", "focused leadership", and "will restore a positive city hall."  If this is how those characteristics will be demonstrated before even taking the "Love Seat", we can't imagine what to really expect from the "Rat Pack".  What the "Rat Pack" did was very low life, classless, arrogant, despicable, and reprehensible not just to Mayor Olson and his campaign advisors, but to the 11,800 Franklin voters who cast their ballot in the Mayoral election and to the staff that work at City Hall.

Waterford PD Produces Open Records Proving Nelson was Not Truthful and uses Waterford PD email for Franklin Business



After indicating no such records exist, the Town of Waterford Police Department released 94 responsive open records pertaining to Franklin Mayor, John Nelson, who is also a Full-time Lieutenant for the Waterford Police Department.

What information do the responsive records provided by the Waterford Police Department illustrate:

  1. Mayor Nelson of Franklin is using his Waterford Police Government email address for Franklin Public Business.
  2. Mayor Nelson is Cc: many of his Franklin emails to the Waterford Police Government email.
  3. Mayor Nelson and his Mayoral election campaign committee of County Supervisor Steve Taylor, Mike Zimmerman Rock CEO, and former Franklin Alderwoman Kristin Wilhelm appeared to be completing final edits on Nelson's campaign literature, and Nelson cc: email to his Waterfordpd email account.
  4. It appeared that on more than one occasion Alderwoman Eichmann would send Franklin business to the mayor's Waterford Police email.
  5. Many of the emails contained Nelson's personal email address john.1968Nelson@gmail.com, proving that the Mayor indeed had emails to his personal email address and was untruthful in his response that he did not.
  6. Franklin Director of Administration Kelly Hersh appeared to use Nelson Waterford's email address on multiple occasions to conduct City of Franklin Business.
  7. Nelson was corresponding with the Milwaukee County Republican Party as candidate Nelson as part of his election campaign using his Waterfordpd email.
One would question if the use of another government account, separate from the Franklin.gov email account is an appropriate use of a government (non-Franklin) email account.

FCN previously reported on April 3, 2024, that Neilson violated the Wisconsin Open Records Law by not providing records to his personal (John.1968Nelson@gmail.comemail account and the (jnelson@waterfordpd.comemail account.  The Mayor denied having records as part of a request from Franklin Community News (FCN) when in fact he knowingly had the records and was untruthful in his response.  FCN had the records in its possession from a different request, the same records the Mayor denied having in his personal accounts in his official response.

Franklin Community News (FCN), sent an open records request to the City of Franklin, City Clerk on March 5, 2024, requesting the following open records:

I am requesting the following open records from April 2023 to March 1, 2024  from both Ms. Hersh and Mr. Nelson's personal email accounts.

Any emails containing  or Taylor, or Zimmerman or Busalacchi or MATC or Milwaukee Area Technical College.

On March 14, 2024, at 2:33pm the City Clerk sent an email with an attachment to FCN.  The attachment was an email from Kelly Hersh indicating that if there were any emails Jim (IT Director) would find them in the query.

Just about an hour later the same day at 3:07pm John Nelson sends an email indicating that:

City domain only, I have no other communication.

At 3:13pm Busalacchi sent the following response to Nelson:

Not true sir.  I’m in possession of emails to your Gmail account that meet my request.  Would you like to check one more time.  Personal email accounts are subject to open records under ss 19.31.

At 3:13 the Franklin City Clerk sent the following to Busalacchi:

Mr. Busalacchi, I will forward your email to Mrs. Hersh and Mayor Nelson again.  

What Nelson was unaware of was that Franklin Community News already had a previous open records request that was provided which included two emails, one from his personal email account and another from his public work email, that met the requested criteria:


Email 1
 - Director of Administration Hersh replying to an October 6, 2023 email of Michelle Eichmann and she Cc: John.1968Nelson@gmail.com which is Nelson's personnel email account.  The email contained the search criteria "Steve Taylor" and "Mike Zimmerman".

Email 2 - On December 28, 2023, John Nelson replied to Mike Zimmerman and Cc: jnelson@waterfordpd.com his public employment email.  This email contained the search criteria "Mike Zimmerman".

A records request was sent to the Town of Waterford Police Department that specifically requested any emails to or from jnelson@waterfordpd.com from February 1, 2023, until March 18, 2024, that contain any of the following, Busalacchi, Taylor, Zimmerman, ROC, ROC Ventures, ROC Foundation, Franklin, MATC, Milwaukee Area Technical College. The request was sent to Lieutenant William Jeschke to be completed. 

On April 4, 2024, FCN received an email from Acting Chief Lieutenant Jeschke indicating “no record of any of these requested items was located”.

FNC replied “I would like to politely ask that the search for the responsive records be conducted again. I have two records in my possession that meet the criteria below and were sent to the waterfordpd.com email. If there are two records I am sure there are more. If you could conduct the search again it would be appreciated. If it would be helpful for me to come to the station, I would be more than happy to show you the records I have. I am seeking the requested records as soon as possible.”

FCN already had in its possession a record that met 6 of the search criteria presented for responsive records. So it's impossible that the search for responsive records was null. I called the Town of Waterford City Clerk and asked for her assistance to intervene which she agreed to do. The perception now is that since Nelson is a Lieutenant in the Waterford Police Department and so is the Acting Chief Jeschke, was Jeschke covering up for Nelson and purposefully denying access to open records under WI Statute 19.35 to cover for Nelson?
Jeschke indicated the search was conducted by their IT director.  It seems almost impossible that an IT professional would conduct a search for records and one record containing 6 of the criteria is not pulled up as part of the query.  We know for sure there are at least two records and are willing to bet there are many more responsive records at jnelson@waterfordpd.com.

Jeschke is a Lieutenant who is Acting Chief and Nelson is a Lieutenant.  Is it possible that Jeschke was covering for Nelson?

On April 18, 2024, Acting Chief, Lieutenant Jeschle sent the following:

"I apologize for the delay.  I have attached the lmessage I received from our IT email vendor.  As you can see, there was an issue with the search function or our email system, which has now been resolved and your request has now been fulfilled." 

  • Wisconsin State Statue 19.31 which governs WI Open Records Law states:

    In recognition of the fact that a representative government is dependent upon an informed electorate, it is declared to be the public policy of this state that all persons are entitled to the greatest possible information regarding the affairs of government and the official acts of those officers and employees who represent them. Further, providing persons with such information is declared to be an essential function of a representative government and an integral part of the routine duties of officers and employees whose responsibility it is to provide such information. To that end, ss. 19.32 to 19.37 shall be construed in every instance with a presumption of complete public access, consistent with the conduct of governmental business. The denial of public access generally is contrary to the public interest, and only in an exceptional case may access be denied.

    Wisconsin State Statue 19.32(2) Defines a "Record" as:

        Record" means any material on which written, drawn, printed, spoken, visual, or electromagnetic information or electronically generated or stored data is recorded or preserved, regardless of physical form or characteristics, that has been created or is being kept by an authority. “Record" includes, but is not limited to, handwritten, typed, or printed pages, maps, charts, photographs, films, recordings, tapes, optical discs, and any other medium on which electronically generated or stored data is recorded or preserved. “Record" does not include drafts, notes, preliminary computations, and like materials prepared for the originator's personal use or prepared by the originator in the name of a person for whom the originator is working; materials that are purely the personal property of the custodian and have no relation to his or her office; materials to which access is limited by copyright, patent, or bequest; and published materials in the possession of an authority other than a public library that are available for sale, or that are available for inspection at a public library.

    The 2019 Wisconsin Public Records Law Compliance Guide (Page 3) indicates:

      Email sent or received on an authority’s computer system is a record.

    This includes personal email sent by officers or employees of the authority.


      Email conducting government business sent or received on the personal email account of an authority’s officer or employee also constitutes a record.

    Wisconsin State Statue(s) 19.37 (3)(4) Defines "Enforcement" and "Penalties" as:

    (3) Punitive damages. If a court finds that an authority or legal custodian under s. 19.33 has arbitrarily and capriciously denied or delayed response to a request or charged excessive fees, the court may award punitive damages to the requester.

    (4) Penalty. Any authority or legal custodian under s. 19.33 who arbitrarily and capriciously denies or delays response to a request or charges excessive fees may be required to forfeit not more than $1,000. Forfeitures under this section shall be enforced by action on behalf of the state by the attorney general or by the district attorney of any county where a violation occurs. In actions brought by the attorney general, the court shall award any forfeiture recovered together with reasonable costs to the state; and in actions brought by the district attorney, the court shall award any forfeiture recovered together with reasonable costs to the county.

Is the Town of Waterford PD Complicit in Withholding Open Records to Cover for Franklin Mayor Nelson?


 You just can't make this stuff up.   No matter what the critics believe, it's all true!


The Town of Waterford Police Department may have been working with John Nelson, Mayor of Franklin, to intentionally and purposefully withhold responsive records under the Wisconsin Open Records Law.  John Nelson is a full-time Lieutenant for the Town of Waterford Police Department.

  • As Busalacchi indicated during public comment at the April 3, 2024, Franklin Common Council meeting, when interrupted by the Mayor, December 28th was a paid holiday. MATC was closed for operations the week between Christmas and New Year.  Busalacchi publicly indicated in the Franklin Community News Blog, that the message was sent from his iPhone, and he forgot to select his personal account rather than the default MATC account. A search of MATC records will reveal that this was the only email that ever used the MATC domain for his blog.

Franklin Community News Banned from Franklin Social Media Groups for Exposing Nelson, Taylor, Zimmerman and Circle of Corruption

 


Within the last two days, Franklin Community News (FCN) has been removed and banned from a new start-up discussion group in addition to the Franklin Group to Rule Them All.

This appears to be continued censorship as a result of FCN exposing the corruption of Franklin Mayor John Nelson and his ties to Mike Zimmerman, Owner/CEO of ROC Ventures, and Steve Taylor, Milwaukee County Supervisor and Executive Director of ROC Foundation.

Certain members in this community want to believe FCN is all the work for former Mayor Steve Olson and is somehow tied to him, and he is the wizard behind the curtain. Not true False.....but good conspiracy theory.

There are some in this community who continue to question the legitimacy of what FCN is providing and call it a lie.  However, whenever pressed about what is NOT Factual, NO ONE can provide a direct response and point out one piece of information that is not FACT.  All blogs are based on Open Records or first-hand sources.

Some call the FCN blog over the top and slanted toward a hatred of Nelson, Taylor, and Zimmerman.  That is correct our blogs are "slanted".  Not with hatred but with facts and to provide the transparency that Mayor Nelson indicated he would do if elected which he has not, one year since April 4, 2023.

Some are calling us out for using publicly accessible photos and/or creating collages of Nelson, Taylor, Zimmerman, and Hersh with certain candidates.  Yes guilty.  As a candidate, if you want to be in a picture with individuals who are questionable and participate in a proven circle of corruption, that is your choice. Don't call your friends who run community discussion groups and cry.  Own it...you posed for the pictures in a public venue and posted them in a public space. It then becomes your choice to explain why you are associating with certain individuals whom the local media has called corrupt.  One local media outlet listed Taylor and Zimmerman as a 2023 Loser of the Year.

Maybe the issue is since most of Franklin's Discussion Groups are being encouraged to ban FCN, they think it's going to ground us. Well, it is just the opposite.  To get out the REAL NEWS of what is happening particularly in Frankin City Hall and in our two County Supervisory Districts, we have created paid advertising to disseminate FCN News directly to resident's Facebook Feeds.  As a result, FCN's page (https://www.facebook.com/franklincommunitynews) has over 1300 followers.

In addition, we have acquired a local Facebook community group that has been rebranded and repurposed to the South Suburban Community of Milwaukee County (https://www.facebook.com/groups/425503077818968) which has 4,100 members mainly in Franklin, Oak Creek, and Hales Corners.

Maybe the true reason we have been banned is that we have exposed the truth with FACTS about corruption in our government at Franklin City Hall and had an influence on educating citizens to make an informed decision at the ballot box.

No one is forcing anyone to to read FCN.  Just as with cable news there are slants based upon philosophical and governmental beliefs.  You can change the channel from FOX to CNN, to MSNBC, and others.  Just as you can read the point of view of FCN or not read it.

We can understand how some may feel disenfranchised and disempowered because we are not delivering the narrative that Nelson, Taylor, Zimmerman, and the circle of corruption want you to hear.  It goes against their narrative.

We can be banned by all of the Franklin Facebook Community Groups so they can protect the circle of corruption but WE ARE NOT GOING ANYWHERE.
